By placing an order (registering, purchasing, or using the site) with Global iWay, you confirm that you are in agreement with and bound by the terms and conditions below.

Global iWay will carry out work only where an agreement is provided either by email, telephone, mail or fax. Global iWay will carry out work only for clients who are 18 years of age or above. An ‘order’ is deemed to be a written or verbal contract between Global iWay and the client, this includes telephone and email agreements. We cannot assure that the site is completely free from exploits. If a user is caught exploiting any area of Global iWay, their account will be permanently terminated. If you want to downgrade any of our serivces from higher package to lower package then intimate us via mail 20 days prior to the invoice date. If the mail is sent on or after the invoice date means the downgrade of packages will be done only from the next month billing cycle.

Hosting Data Transfer Limits Our monthly data transfer limit is 10 times the package space you have opted for, which will be automatically reset every month. If data transfer exceeds this limit you can upgrade your package. Global iWay recommends hosting companies to host websites, no guarantees can be made as to the availability or interruption of this service by Global iWay cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.

Payment Policy & Billing Procedures All accounts are set up on a pre-pay basis. We accept payments via Check, Debit Card, Credit Card, PayPal, and Online Fund Transfer. Setup fees are charged for all new accounts that are paid on a monthly basis and major account changes and are non-refundable. All pricing is guaranteed for the term of pre-payment. Global iWay reserves the right to change prices at any time. Payment is due each anniversary month or period following the date the account was established. If 5 days have passed and payment has not been posted, the account will be suspended until further notice. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies Global iWay to request termination of services. Our priority is to serve our customers and provide them with the highest quality of service we can. If for some reason you would like to request a refund please contact our customer care team at admin @ globaliway.net Amount once paid will not be refunded on any accounts. Customers may or may not avail any alternative service of equivalent or less value. But this condition depends solely on the decision of the management. Any chargebacks or reversed transactions made on your payments will result in your account being immediately terminated. Global iWay reserves the right to change the product/service price and features with/without issuing any notice/any reasons thereafter.

Passing of Rights Once all amounts due to us from you are paid and cleared you are assigned the rights to use, as applicable, the products and services, including, the web site which includes the text, graphics, animation, audio components and digital components contained within the finished web site, in accordance with these terms and conditions, the Project Agreement and any applicable agreement, terms or licence but no rights of ownership are conveyed unless specifically stated in the Project Contract. No such rights as described in above will pass until all amounts due to us from you are paid. This means that we will have a lien over any service, products, data or information. If you have not paid the invoice in full within 1 month from the date of the invoice you agree that you will forfeit your rights. The rights to photographs, graphics and any third party items such as source code, always remain the property of their respective owners. Unless you have our specific written agreement in the Project Contract, all products, including Content Management Systems, interfaces, navigational devices, menus, menu structures or arrangements, icons, help, all operational instructions, scripts, cgi applications, software, programming/source code, and all other components of any source or object computer code that comprises the Website, all literal and non-literal expressions of ideas that operate, cause, create, direct, manipulate, access, or otherwise affect the Content and design elements used or developed and all software, and our products and results of our services remain our property and we retain full ownership rights and all intellectual property rights. You specifically agree not do anything that may in any way infringe upon or undermine our rights, title, or interest in the Website or our products and services. This includes, but is not limited to, any sale, transfer or gift of the whole or of any part of any item, data or anything whatsoever that we own. You fully understand that we may reproduce, reuse, develop and use in any other way we choose, anything within our ownership.

Complaints Procedure
Informal procedure
1. Anyone who experiences a problem with their web service provided by Global iWay should raise the matter directly using our online contact form to do so, giving sufficient information to locate the material (such as an url) and clearly outlining the grounds for complaint.
2.Global iWay will approach the individual responsible for the material in question with a view to resolving the matter to the satisfaction of the complainant.

Formal complaints procedure
1. The formal complaints procedure should only be used where the complainant feels that the nature of the complaint is too serious to be dealt with informally, or where a satisfactory conclusion has not been reached after following the informal procedure.
2. A formal complaint should be made in writing to Global iWay, who will acknowledge receipt and ensure that the matter is looked into as soon as possible.
3. An initial response to any complaint can be expected within seven days of its receipt; a full and considered response to the complaint should be completed within 30 days and any subsequent remedy implemented with the minimum of delay. SHOUTCAST – RADIO STREAMING
Your Account

We reserve the full right to terminate your account at any time, with or without given notice. Your account WILL be terminated if you are found in violation of any of these terms.

If your account is terminated due to a violation of the Terms of Service, a refund will not be provided. If your account is terminated for some other reason, it is at our sole discretion if a refund will be given. In order to register on our site, you are required to have a valid unique email address. When ordering a SHOUTcast server from Global iWay, you are only renting the SHOUTcast server. All services remain the property of Global iWay. Maximum Bitrate

You may only use up to the maximum bitrate that you purchase. If you attempt to use a higher bitrate, you will automatically be disconnected and later suspended from our server.

Licensing and Other Legal Obligations
You are responsible for meeting the legal requirements for your station. This may include, but is not limited to, internet radio licensing. We claim no responsibility whatsoever for what you choose to stream on your server. You may not use our services to distribute adult or illegal material.

Liability Global iWay will not be liable for delays or failure in performance caused by acts of God, war, terrorism, strike, labor dispute, work stoppage, fire, act of government, or any other cause, whether similar or dissimilar, beyond our control. Global iWay reserves the right to restrict, alter, or modify fees, benefits, rules, regulations, special offers, membership terms and conditions or terminate services at any time and without notice. Global iWay is not liable to store any statistical data regarding servers, such as listener information. Global iWay is not liable to keep any user data, such as songs uploaded to the service, for users that have either cancelled their service or have an inactive subscription.

Unlimited Services and Free Addon
In the best interest of our subscribers, Global iWay does not put a limit on the amount of listeners / viewers that may connect to the server, nor the amount of bandwidth a server may use. With SHOUTcast servers, the software requires a maximum number of listeners to be set. By default, your SHOUTcast server will be installed with a limit of 1,000 listeners. If needed, this may be increased at any time by contacting Global iWay customer support. The unlimited service offered on our site is intended for personal sites. In case you use it for any Organisations, home businesses, small businesses and large business. Kindly contact Global iWay customer support. Our service mentioned in this website is not intended for large enterprises, you can contact Global iWay customer support for dedicated server. In Shoutcast streaming package, mobile streaming rtsp is offered us free add-on. This add-on is provided only on request. Any free add-on services will not be covered under our support. Global iWay reserves the rights to remove any add-on service at any time. Free website space add-on is offered only for hosting that particular website pages only. Any Audio / Video content is uploaded or used for FTP purpose means the service rendered will be terminated without intimation.

Auto DJ Service
By choosing to use our free Auto DJ service, you are agreeing to abide by all terms & conditions set out on this page. Auto DJ” is included as a free service with your Global iWay account that enables you to stream music from our servers Our “Auto DJ” service is provided as a free service. We offer no guarantees regarding the quality of this service, although we will do our best to provide optimal quality. We reserve the right to discontinue our free “Auto DJ” service at any time. Our free “Auto DJ” service enables you to upload MP3 music files to our server and then stream the music from our server. You are only permitted to upload and stream MP3 tracks that are legally in your possession. If we find you violating our terms then your account will be terminated permanently. The service enables you to control the order songs play in, or optionally, play songs in a random order. Additionally, you may modify aspects of the service, such as fade time for songs. We restrict the right to remove and/or add features at any time. We claim no responsibility whatsoever for what you choose to stream using our free “Auto DJ” service. You may not use our free “Auto DJ” service to distribute adult or illegal material. Using our free “Auto DJ” service, you are still responsible for meeting the legal requirements for your station. This may include, but is not limited to, internet radio licensing. As our “Auto DJ” service is provided as a free service, no refunds will be given for any reason in relation to this service. We reserve the right to modify any of the information on the Global iWay site at any given time.

Auto Detect Mobile Stream is possible only when hosting service is availed from us.
